Repco Staff Incentive Terms and Conditions

PROMOTER

Castrol New Zealand Ltd (NZBN 9429049090659), having its principal office at Ground floor, Watercare House, 73 Remuera Road, Newmarket, Auckland 1050, New Zealand.

 

COMPETITION PERIOD

12.01am (NZT) on 01/08/2023 to 11.59pm (NZT) on 03/09/2023.

 

WHO CAN ENTER

  • This competition is available to the New Zealand Repco stores set out in Appendix 1 to these Terms and Conditions(each a Store, together the Stores).

The manager of a Store can enter the competition on behalf of the Store.

 

WHO CAN't ENTER

Any Store whose manager is also a director, officer, or employee or has an immediate family member that is a direct, officer or employee of:

  • the Promoter; and
  • the agencies, companies or participating premises associated with this competition;

is not eligible to enter this competition.

 

Where will the Competition run?

The competition will run in participating Stores in New Zealand.

 

WHAT DO I NEED TO DO TO ENTER

To enter the competition, a Store must during the Competition Period:

 

(a) increase sales (by value NZD) of Castrol products by a minimum of 8% compared to:

  •  the same period last year being 01/08/2022 to 03/09/2022  (the Base Period), based on the Promoter's sales figures; or
  •  where there is no prior sales history for the same period last year, the Set Target (defined below);

(in each case, the Competition Period Growth); and

 

(b) display (and continue to display throughout the Competition Period) in Store the promotional material for the 'Win a Ford Escape Hybrid’ Promotion (as provided by the Promoter) in a creative way;

(together the Entry Requirements).

 

A representative of the Promoter may attend your Store to see if your Store has successfully fulfilled all of the Entry Requirements listed above. If the Promoter is not satisfied that your Store has fulfilled the Entry Requirements (whether assessed on the basis of a Store visit or otherwise), you may be disqualified in the Promoter's reasonable sole discretion.

 

Once the Promoter determines that you have successfully fulfilled the Entry Requirements listed above, your Store will automatically receive an entry into the competition.

 

All judging decisions are as determined by the Promoter, in their sole and absolute discretion.

 

Set Target: If a Store does not have prior sales history for 01/08/2022 to 03/09/2022, the Store will be allocated a set target by Repco head office, based on past months’ performance (Set Target).  

 

HOW MANY WINNERS WILL BE THERE AND HOW WILL THEY BE CHOSEN?

There will be six (6) winning Stores in this competition; two (2) winning Stores from Area 1 (North ), two (2) winning stores from Area 2 (Central) and two (2) winning Stores from Area 3 (South). Area1, Area 2 and Area 3 are made up of Stores as defined by Repco in Appendix 1 of these Terms and Conditions (each an Area, together the Areas).

 

Chance plays no part in how the winners will be selected.

 

The two (2) winning Stores from each Area that meet the below criteria will each win a prize:

  • have successfully fulfilled the Entry Requirements set out above;
  • of the participating Stores in the relevant Area, have recorded the highest Competition Period Growth (For the avoidance of doubt, only refunds and returns recorded during the Competition Period will affect a Store's Competition Period Growth"); and
  •  have maintained throughout the Competition Period an impactful (as determined by the Promoter in its sole and absolute discretion) Castrol in-store display that brings prominence to the Castrol brand and the 'Win a Ford Escape Hybrid' promotion. The in-store display shall use all in-store promotional material provided to the Store in connection with the ‘Win a Ford Escape Hybrid’ promotion (as determined by the Promoter) and shall display and provide in-store visibility to Castrol product.

 

The two (2) winning Stores from each Area (total of six (6) winning stores), will be ranked from highest to lowest percentage increase in Competition Period Growth and will be awarded prizes accordingly. That is, the Store with:

 

  • the highest Competition Period Growth percentage increase for the relevant Area will win the 1st place prize for that Area;
  • the second highest Competition Period Growth percentage increase for the relevant Area will win the 2nd place prize for that Area; and

    

If two (2) or more Stores within an Area achieve the same Competition Period Growth and are eligible for a prize according to the conditions set out above, those two (2) Stores will be ranked and the prize will be awarded on the basis of whichever Store has displayed the 'Win a Ford Escape Hybrid’ promotion materials (as provided by the Promoter) in the most creative way, as judged by the Promoter.

 

All judging decisions are as determined by the Promoter, in their sole and absolute discretion.  The winners will be determined by the Promoter at 12.00pm (NZT) on 03/10/2023 at 73 Remuera Road, Newmarket, Auckland 1050 (Determination Date). 

 

WHAT CAN I WIN

There are two (2) prizes to be won per Area, as set out below: 

 

New Zealand Area 1 Stores: 

  • 1st place – Up to 10 x $150 Prezzy gift cards
  • 2nd place – Up to 10 x $80 Prezzy gift cards

 

New Zealand Area 2 Stores:

  • 1st place – Up to 10 x $150 Prezzy gift cards
  • 2nd place – Up to 10 x $80 Prezzy gift cards

 

New Zealand Area 3 Stores:

  • 1st place – Up to 10 x $150 Prezzy gift cards
  • 2nd place – Up to 10 x $80 Prezzy gift cards

 

For the avoidance of doubt, there are a total of six (6) prizes to be awarded across the Area and each prize is made up of up to ten (10) Prezzy gift cards. The number of Prezzy gift cards awarded to each winning Store may vary depending on the number of nominated staff per Store, but in any case shall not exceed ten (10) Prezzy gift cards per winning Store.

 

The Prezzy gift card is subject to the following terms and conditions:  https://www.prezzycard.co.nz/terms-and-conditions. Any ancillary costs associated with redeeming the Prezzy gift card are not included.

 

WHO WILL THE PRIZE GO TO

Each prize will be awarded to the Store manager of each winning Store, to be distributed to nominated staff members (to be decided by the Store manager in its sole and absolute discretion. Staff members shall be nominated by the Store manager in accordance with the following conditions:

 

  •  to be eligible, a staff member must have been employed by the Store for the duration of the Competition Period and at the time of delivery of the Prezzy gift cards (Eligible Staff Members) (For the avoidance of doubt, the Store manager who is responsible for nomination and distribution of the Prezzy gift Cards for a Store is entitled to receive a Prezzy gift Card);
  •  the store manager will nominate and distribute the Prezzy gift cards in a fair and reasonable manner, and in accordance with any applicable law and/or Store policies. The Promoter will not be liable for any decisions in this regard;
  • there will be no more than one (1) Prezzy gift card awarded per Eligible Staff Member (even if there are fewer than ten (10) Eligible Staff Members employed by a Store); and
  •  if a Store has fewer than ten (10) Eligible Staff Members, it shall only be awarded a Prezzy gift card per Eligible Staff Member.

Prizes will be delivered to each Store via post within 10 (ten) days of the Determination Date.

 

TOTAL PRIZE POOL

The total prize pool is up to NZD $6,900.

 

How many times can I enter?

Each Store can enter the competition once.

 

HOW AND WHEN WILL THE WINNER/S BE INFORMED?

Winning Stores will be notified in writing by email within five (5) business days of the Determination Date.

 

UNCLAIMED PRIZE/S

Prize Claim Date: 5pm on 13/10/2023.  

 

If a prize has not been accepted or claimed by the prize claim date above or if, after making all reasonable attempts, the Promoter can't contact a winning Store (or a representative from a winning Store does not contact the Promoter) by the prize claim date above, the relevant entry will be discarded and the Promoter will re-award the relevant prize/s to the Store with the next highest Competition Period Growth percentage increase for the relevant Area (and that otherwise meets the entry criteria for the Competition, as set out in these Terms and Conditions). 

 

COLLECTION AND USE OF YOUR PERSONAL INFORMATION

If your Store is a winning Store, the Promoter may ask you and your staff to take part in some publicity, photography and other promotional activity as the Promoter reasonably requires, without any compensation.  You consent, and you agree to procure your staff’s consent, to the Promoter using your and your staff’s names and images and indicia in any promotional or advertising activity. Additionally, you agree, and you agree to procure the agreement of your staff, to grant the Promoter a perpetual, irrevocable and exclusive license to use any photographs in all media worldwide, including online social networking sites, without compensation to you, your Store or your staff.

 

The Promoter may collect personal information about you and your staff in order to conduct and manage the competition. If the personal information requested is not provided, you/they may not be able to participate.

 

The Promoter’s Privacy Policy (available at https://www.castrol.com/en_nz/new-zealand/home/privacy-statement.html) states:

 

(a) how you can seek access to the personal information the Promoter holds and seek the correction of such information; and

 

(b) chow you can complain about a breach of privacy and how the Promoter will deal with such a complaint.

 

Additional purposes: In addition to the purposes stated in the Privacy Policy, the Promoters may also use your personal information to help improve its goods and services.

 

Additional uses: In addition to the uses outlined in the Privacy Policy, the Promoters may share your personal information with the Promoters’ franchised dealers, related companies, agents, contractors or promotional partners for the purpose of conducting and managing the promotion.

These Terms and Conditions incorporate and must be read together with the details outlined in the table above.  Information about prizes and how to enter forms part of these Terms and Conditions.  By entering, you accept these Terms and Conditions.

 

Entry

To enter the competition you must satisfy the Entry Requirements during the Competition Period. Your Store will be automatically entered into the competition once you provide details of satisfying the Entry Requirements to the Promoter, such details have been received by the Promoter and the Promoter has confirmed that, in its sole and absolute discretion, your Store has satisfied the Entry Requirements. The Promoter is not liable for any problems with communications networks.  You are responsible for your own costs associated with entering.

The Promoter may copy and amend your entry and may use (or allow others to use) your entry and any rights in relation to your entry, to publicise this competition or for any other purpose.  These rights are perpetual, royalty-free, worldwide, irrevocable, and transferable.  For example, the Promoter may publish all or any part of your entry or any amended version of it.  The Promoter may also decide not to publish an entry, to cease publication of an entry, or to publish an edited entry.

You warrant that your entry does not breach any third party rights (for example, intellectual property rights) and its use by the Promoter or any other person will not breach such rights nor otherwise breach any law (for example, it is not defamatory, in contempt of court or in breach of any privacy law).  Your entry must not be obscene, offensive, malicious, discriminatory, indecent or (in the Promoter's opinion) otherwise objectionable or inappropriate (for example it must not include nudity or language the Promoter deems offensive).

You must ensure your entry does not contain any virus, malware or other malicious or inappropriate computer code or material.

 

PRIZES

Prizes and all elements of prizes must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable. Prizes are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter, including validity periods.

 

7                  

The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share a prize.

 

General

Any failure by you or your Store to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier(s).

If you or your entry are deemed by the Promoter to breach these Terms and Conditions, including if the Promoter considers a winning Store to have a bad credit history or be a credit risk, due to breaching or having at any time breached credit arrangements with the Promoter, your entry (or at the Promoter's discretion, all of your entries) may be discarded.  The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries. Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.

You must not:

  • tamper with the entry process (including but not limited to manipulating the system via bots, script use, or any other means to circumvent the entry process);
  • engage in any conduct that may jeopardise the fair and proper conduct of the competition;
  • act in a disruptive, annoying, threatening, abusive or harassing manner;
  • do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;
  • breach any law; or
  • behave in a way that is otherwise inappropriate.

The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.

If any dispute arises between you and the Promoter concerning the conduct of this competition or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time.  In all other respects, the Promoter’s decision in connection with all aspects of this competition is final, including in respect of any Set Targets and the assessment of a Store’s Competition Period Growth.

Prizes cannot be transferred or exchanged nor redeemed for cash.  Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement.  The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST.  The Promoter is not responsible for any change in prize value.  You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by relevant authorities (if any).

If this competition cannot run as planned for any reason beyond the Promoter's control (for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, government directives, a pandemic, public health orders and the like), the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to any necessary approval by relevant authorities (if any).

The Promoter is not responsible for any tax implications arising from you winning a prize.  You should seek independent financial advice.  If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

 

Liability

Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Consumer Guarantees Act 1993 and Fair Trading Act 1986 (Non-Excludable Rights).

Except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law), including liability under the Non-Excludable Rights,  the Promoter (including its officers, employees and agents) and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including loss of profits and loss of opportunity), expense, damage, personal injury, illness or death suffered in connection with this competition or any prize, whether direct, indirect, special or consequential, arising in any way out of the competition or any prize, including without limitation

  • any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
  • any theft, unauthorised access or third party interference;
  •  any entry or prize claim that is late, lost, altered, damaged, or misdirected due to any reason beyond the reasonable control of the Promoter;
  • any variation of the prize value to that stated in the Terms and Conditions;
  • any tax liability incurred by a winner or entrant;
  • use of a prize by any person.

Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of prize/s, or for any damage that occurs to displayed prize/s (where relevant). Unless otherwise specified, prize/s will only be delivered to addresses in New Zealand.
