Terms and Condition Spend and Get offer BP2GO

SPEND & GET OFFER bp2Go

1. The promoter is Castrol New Zealand Limited NZBN 9429049090659, having its principal office at Level 2, Stantec Building, 105 Carlton Gore Road, Newmarket, Auckland 1023, New Zealand (Promoter).

2. The promotion is called "Spend & Get Offer" (Promotion).

3. The Promotion begins at 12.01am (NZDT) on 1 October 2024 and ends at 11.59pm (NZDT) on 31 December 2024 (Promotion Period). Only fully and correctly completed, entries received during the Promotion Period will be accepted and will be deemed to be complete only when received by the Promoter. The Promoter will not be liable for late entries or any entries sent but not received. The Promoter will not be liable for entries, claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.

4. The Promotion will run in participating bp2go Service stations in New Zealand (Service Station).

5. To qualify for the offer, you must purchase $1,200 (excluding GST) or more of Castrol-branded products for sale at your Service Station each month during the Promotional Period via your Castrol account by Castrol Express, emailing orders to orders@castrol.co.nz, or via the Customer Services Team on 0800 CASTROL (Qualifying Entry). For your first Qualifying Entry each month, $100 will be credited to the same Castrol account associated with the Qualifying Entry (Credit).  You can receive a maximum of one Credit per Castrol account each month.

6. Your Qualifying Entry may be made up of a number of separate purchases of Castrol-branded products within each month during the Promotional Period (each, a Qualifying Purchase).  To avoid doubt:

i. each Qualifying Purchase you make each month during the Promotional Period will contribute to the total pool of your purchases relevant to this Promotion (Purchase Total); 

ii. you will only have a Qualifying Entry each month where your Purchase Total is $1,200 or more; and

iii. the value of any Qualifying Purchases you return to the Promoter will be subtracted from your Purchase Total.  The Promoter reserves the right to deem your Qualifying Entry invalid where you return a Qualifying Purchase relevant to that Qualifying Entry after obtaining a Credit and your Credit will be cancelled.

7. Stores who will receive a Credit will be notified by email between the 15th – 20th of the following month of the Qualifying Purchase. 

8. There will be no unclaimed credits.  All Credits will be automatically awarded to participants via the Castrol account associated with their Qualifying Entry.  In order to be awarded a Credit, your Castrol account must be active at the time you make all Qualifying Purchases relevant to your Qualifying Entry, and at the time you would receive the Credit.

9. The Promoter is not liable for where you are unable to obtain a Qualifying Entry or make a Qualifying Purchase due to any problems with communications networks outside the Promoter’s reasonable control.  You are responsible for your own costs associated with entering the Promotion.  

10. If you, your Qualifying Purchase or your Qualifying Entry are deemed by the Promoter to materially breach these Terms and Conditions the Promoter may, at its discretion, discard your Qualifying Purchase or Qualifying Entry.  Failure by the Promoter to enforce any of its rights at any stage does not waive those rights. 

11. You must not:

i. tamper with the entry process (including but not limited to manipulating the system via bots, script use, or any other means to circumvent the entry process);

ii. engage in any conduct that may jeopardise the fair and proper conduct of the Promotion;

iii. act in a disruptive, annoying, threatening, abusive or harassing manner;

iv. do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this Promotion;

v. breach any law; or

vi. behave in a way that is otherwise inappropriate.  

12. Entry is only open to all New Zealand bp2go Service Station Stores with an active Castrol account at the time of all relevant Qualifying Purchases.

13. Employees, officers, management, employees and contractors (including their immediate families) of the Promoter, participating retailers and agencies associated with this Promotion are excluded from entering.

14. The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share a Credit.

15. Your Credit is not transferable, exchangeable, or redeemable for cash. Your Credit must be taken as and when specified, or will be forfeited with no replacement. The Credit’s value is correct as at the date of preparing these Terms and Conditions. 

16. If for any reason the Promotion is not capable of running as planned, including, but not limited to, infection by a computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the Promoter's or its agent's reasonable control, which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Promotion, the Promoter reserves the right, in its discretion, to cancel, terminate, modify, or suspend the Promotion.Where it is practical for it to do so, the Promoter will notify you of such changes.

17. Neither the Promoter nor its agents will be responsible for Qualifying Entries lost in transmission or received late due to high traffic levels, technical malfunctions, or otherwise. 

18. To the maximum extent permitted by law, the Promoter is not responsible for any tax implications arising from you receiving a Credit.  You should seek independent financial advice.  If, for GST purposes, this Promotion results in any supply being made for non-monetary consideration, you must follow the New Zealand Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

19. If any dispute arises between you and the Promoter concerning the conduct of this Promotion or claiming a Credit, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time.  In all other respects, the Promoter’s decision in connection with all aspects of this Promotion is final.

20. Participants will be advised of any additional terms and conditions that apply to the Credit, including, as relevant, validity periods.

21. Personal information provided by you in the Promotion will be used by the Promoter, and may be disclosed to the Promoters’ related companies, agents, contractors or promotional partners, for the purpose of conducting this Promotion. 

22. The Promoter’s Privacy Policy (available at https://www.castrol.com/en_nz/new-zealand/home/privacy-statement.html) states:

i. how you can seek access to the personal information the Promoter holds and seek the correction of such information; and

ii. how you can complain about a breach of privacy and how the Promoter will deal with such a complaint.    

23. Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the New Zealand Consumer Guarantees Act 1993 (Non-Excludable Guarantees).

24. Except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law), including liability under the Non-Excludable Guarantees,  the Promoter (including its officers, employees and agents) and the agencies and companies associated with this Promotion are not liable (including in negligence) for any loss (including loss of profits and loss of opportunity), expense, damage, personal injury, illness or death suffered in connection with this Promotion or any Credit, whether direct, indirect, special or consequential, arising in any way out of the Promotion or any Credit, including without limitation: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Credit claim that is late, lost, altered, damaged, or misdirected due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a participant; (e) use of a Credit by any person.   

25. If any of these Terms and Conditions are determined to be illegal, invalid or otherwise unenforceable, then the remaining terms and conditions shall continue in full force and effect.

26. These Terms and Conditions and any non-contractual obligations arising out of or in connection with them, shall be governed by and construed in accordance with New Zealand law.  Disputes arising out of or in connection with either the Promotion or these Terms and Conditions shall be subject to the exclusive jurisdiction of the New Zealand courts. 

27. By submitting a Qualifying Entry (whether valid or not) you are deemed to have accepted these Terms and Conditions.

28. This Promotion is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and Twitter.  You provide your information to the Promoter and not to any social media platform.  You completely release any relevant social media platforms from any and all liability.
