These are the Terms and Conditions that apply to the text messaging service provided by Castrol to recommend an oil for Your vehicle (the "Service"). By using the Service, You are acknowledging and also agreeing with Us that You will be bound by and comply with these Terms and Conditions.In these Terms and Conditions, the words "We", "Our", and "Us" all refer to Castrol Ltd, a company incorporated in England, together with its successors or assigns. The Words "You" and "Yours" are references to any person who uses the Services. In other words, You are Our customer and We supply the Service to You.
1. The Service Description - what We do, and what You do
1.1 We are glad that You have chosen to use the Service. We hope that You find it useful.1.2 We are not perfect and We sometimes make mistakes. For example, sometimes We get incorrect information supplied to Us by another person. In supplying this Service, We assume that: (i) You will only use the Service for information purposes; and (ii) You will not rely upon the Service in making a final decision about what oil you should use for your vehicle.
1.3 We also do not want people to abuse our Service. You agree: (i) You will not use the Service in violation of any applicable law or regulation; (ii) You will not use the Service for any purpose that would result in, or otherwise be related to, any unlawful activity; (iii) You will not misrepresent Your identity or Your contact details; and (iv) You are fully authorised to employ the payment mechanism used to pay for the Service. We will be relying upon each of these statements from You just as if you repeated them to us every time You use the Service. We reserve the right to suspend the Service or and/or refuse to answer any text from you if, in Our opinion, We believe there has been a violation of these Terms and Conditions.
1.4 Remember that We are supplying information to You. If You choose to display or transmit an answer to any other person then You agree to take sole responsibility for the result. You must also comply with the terms of the permission we grant below in the discussion of intellectual property.

3.1 We (and other people who grant licences to Us) own all intellectual property rights that subsists in or arise in the operation of the Service. For example, these include rights in the technology used to compile Our information that is used to select what We believe is the most relevant oil for You based on the Information We have received from you, any database rights in this information and our various trademarks and intellectual property.3.2 When You submit a text to Us We will send you a text back informing You that Castrol has sent You a text and letting you know the cost of the Service to You . We will then send a further text delivering a WAP link for You to click on to get information about what We think may be the right oil for Your car. You therefore need a WAP enabled phone to access the Service.
4. Payments
4.1 You agree to pay the fees for any Service requested by You or by any other person who is authorised by You to use Your payment device.5. Termination or suspension
5.1 We do not guarantee that We will continue to supply the Service indefinitely. We can stop supplying the Service at any time without notice, and We reserve the right to refuse to supply the Service to any person.6. If You need to contact Us

7.1 We have described above what You should expect from Us when we supply the Service. The descriptions above are the only premises We make about the Service.7.2 WE HEREBY EXCLUDE AND DISCLAIM ALL OTHER TERMS AND CONDITIONS THAT WOULD OTHERWISE BE IMPLIED BY OPERATION OF APPLICABLE LAW INCLUDING WITHOUT LIMITATION TERMS CONCERNING SATISFACTORY QUALITY, MERCHANABILITY, AND FITNESS FOR PURPOSES.
7.3 OUR LIABILITY ARISING FROM OR OTHERWISE RELATED TO THE SERVICE (WHETHER ARISING AS A RESULT OF BREACH OF CONTRACT OR TORT OR BREACH OF STATUTORY DUTY OR ANY OTHER LEGAL OR EQUITABLE BASIS) SHALL BE LIMITED TO THE FEE THAT YOU PAY FOR THE SERVICE.
7.4 No exclusion or limitation in these Terms and Conditions limits Our liability as a result of: (i) death or personal injury caused by Our negligence; or (ii) fraudulent misrepresentation. Your statutory rights are not affected.
8. Amendment, assignment, and governing law
8.1 We can amend these Terms and Conditions at any time. We may notify You of the amendment by changing this document on Our web site. Please check back regularly.8.2 We can assign Our various rights under this agreement to any other person without asking Your permission. Your rights are personal and not assignable.
8.3 These Terms and Conditions are governed by and shall be interpreted in accordance with the law of England. You agree and consent to the jurisdiction of the English courts to resolve any dispute that arises as a result of or in connection with this Agreement.
